تفویض کردہ معاون کو ان شرائط پر پورا اترنا چاہیے جو خلیفہ کے لیے ضروری ہیں، یعنی: مرد ہونا، آزاد ہونا، مسلمان ہونا، بالغ ہونا، عاقل ہونا، عادل ہونا اور اسے سونپی گئی ذمہ داریوں کے حوالے سے اس کام میں مہارت رکھنا جو اسے تفویض کی گئی ہیں۔

The delegated assistant should meet the conditions required in the Khaleefah i.e. to be male, free, Muslim, mature, sane, just and cometent in what is assigned to Him in terms of duties delegated to him.

ان شرائط کے دلائل وہی ہیں جو خلیفہ کے عہدے کی شرائط کے ہیں، لہٰذا مددگار کا مرد ہونا ضروری ہے، کیونکہ رسول اللہ ﷺ نے فرمایا:

Evidences of these conditions are the same as those of the conditions of the Khaleefah post. Therefore, the assistant should be male, for the Messenger of Allah (pbuh) said:

"وہ لوگ کبھی کامیاب نہیں ہوں گے جو کسی عورت کو اپنے معاملات کا سربراہ بنائیں گے۔" [البخاری میں ابی بکرہ رضی اللہ عنہ سے روایت ہے] اس کے لیے آزاد ہونا بھی ضروری ہے، کیونکہ غلام کو اپنے معاملات پر اختیار حاصل نہیں ہوتا، لہٰذا وہ دوسرے لوگوں کے معاملات بھی نہیں چلا سکتا۔ اسے بالغ بھی ہونا چاہیے، کیونکہ رسول اللہ ﷺ نے فرمایا ہے:

“People who appoint a woman to run their affairs shall never succeed.” [Narrated by al-Bukhari on the authority of Abi Bakra] He must also be free, for the slave does not have authority over his own affairs, thus He cannot run other people’s affairs. He should also be mature, for the Messenger of Allah (pbuh) said:

"تین قسم کے لوگ جوابدہی سے مستثنیٰ ہیں: سویا ہوا شخص جب تک وہ جاگ نہ جائے، بچہ جب تک وہ بلوغت کی عمر کو نہ پہنچ جائے اور مجنون (پاگل) جب تک وہ تندرست نہ ہو جائے۔" [ابوداؤد سے روایت ہے] اسے عاقل بھی ہونا چاہیے، کیونکہ اسی حدیث میں رسول اللہ ﷺ نے فرمایا ہے:

“Three types of people are exempted from accountability, the one who sleeps until He wakes up, a child until He reaches the age of puberty and the insane until He is cured.” [Narrated by Abu Dawood] He also should be sane, for in the same Hadith, the Messenger of Allah (pbuh) said:

"...اور وہ مجنون (پاگل) ہے جب تک کہ وہ تندرست نہ ہو جائے۔" ایک دوسری روایت میں حدیث بیان کرتی ہے "...اس شخص کے بارے میں جس کا ذہن قابو سے باہر ہو جائے جب تک کہ وہ اپنے ہوش و حواس میں نہ آ جائے۔" معاویہ کو بھی عادل ہونا چاہیے کیونکہ اللہ (سبحانہ و تعالیٰ) نے گواہی میں اسے ایک شرط قرار دیا ہے۔ وہ (سبحانہ و تعالیٰ) فرماتا ہے:

“...and the insane until He is cured.” In another narration the Hadith states “...about the one whose mind is overpowered until He regains his mind.” Mu’awin should also be just for Allah (swt) has made it a condition in testimony. He (swt) says:

"تم میں سے دو عادل لوگ گواہی دیں۔" [TMQ Al-Baqarah: 282]

“Let two just people from amongst you bear witness.” [TMQ Al-Baqarah: 282]

لہٰذا، خلیفہ کے معاون کے لیے عدل و انصاف کا تقاضا کرنے کی مزید وجہ موجود ہے۔ معاون کو بھی حکمرانی کے فرائض میں اہل لوگوں میں سے ہونا چاہیے، تاکہ وہ خلافت کے کاموں اور حکمرانی و اقتدار کی ذمہ داریوں کو اٹھانے میں خلیفہ کی مدد کرنے کے قابل ہو سکے۔

Therefore, there is more reason to require justice in the assistant of the Khaleefah. The Mu’awin should also be from the competent people in the duties of ruling, in order to be able to assist the Khaleefah in shouldering the tasks of the Khilafah and the responsibility of ruling and authority.
