10.4.6 Punishment as the Last Resort
Debe tenerse en cuenta que los castigos aplicados por el Estado Islámico son el último recurso en el proceso de contener y prevenir el delito. El Islam llega como un dīn (modo de vida) en el que todos los sistemas funcionan en armonía, formando un todo integrado y perfectamente complementario.
It must be noted that the punishments administered by the Islamic State are the last resort in the process of curbing and preventing crime. Islam comes as a deen (way of life) where all the systems work in harmony, making an integrated and perfectly complementary whole.
Así, el Sistema Económico garantizará que todos los ciudadanos del Estado tengan sus necesidades adecuadamente satisfechas, de modo que nadie tenga que recurrir al delito para subsistir. Asimismo, el Sistema Educativo inculcará en las personas la mentalidad de rechazar toda clase de delito, todos los cuales están prohibidos en el Islam, en favor de la obediencia a Allah (SWT). Y el Sistema Social inculcará en las personas la mentalidad de respeto y dignidad hacia el sexo opuesto, y la segregación entre hombres y mujeres en su vida diaria minimizará la posibilidad de delitos en este ámbito.
Thus, the Economic System will ensure that all the citizens of the State will have their needs adequately fulfilled such that no-one need resort to crime to sustain themselves. As well, the Education System will teach the people the mentality of rejecting any kind of crime, all of which are forbidden in Islam, in favour of obedience to Allah (swt). And the Social System will inculcate within the people the mentality of respect and dignity towards the opposite sex, and the segregation between men and women in their daily life will minimise the possibility of crimes in this area.
En el Estado islámico, la prevención del delito funciona en tres niveles:
In the Islamic State the prevention of crime works on three levels :
1) La taqwa del creyente
1) The Taqwa of the believer
El musulmán tiene convicción en el credo racional del Islam, que se fundamenta en el estudio de la realidad y en el uso de la mente. Esto le proporciona la base firme para su creencia en el Islam y lo impulsa a someterse al Único y Verdadero Dios, Allah (SWT).
The Muslim has conviction in the rational creed of Islam, which is built upon the study of reality and use of the mind. This gives them the definite foundation for their belief in Islam and motivates them to be subservient to the One and Only True God, Allah (swt).
El crimen es una desobediencia a Allah (SWT). El anhelo del musulmán por el Paraíso y su temor al castigo del Fuego del Infierno lo apartarán de cometer crímenes.
Crime is a disobedience to Allah (swt). The Muslim’s longing for the Paradise and their fear of the punishment of Hellfire will prevent them from committing crime.

Es uno de los derechos y deberes mutuos de los musulmanes velar siempre por los asuntos de los demás y ocuparse de ellos. Así, habrá una motivación y un estímulo constantes por todas partes para que las personas observen la conducta islámica.
It is one of the mutual rights and duties of the Muslims that they always look out for and take care the affairs of each other. Thus there will be a constant motivation and encouragement from all sides for people to observe the Islamic conduct.
El crimen será repudiado y rechazado por la sociedad en general. Los criminales y los tramposos no serán aceptados, ni tampoco se respetarán la riqueza ni los beneficios aparentes obtenidos de manera ilícita. Esta presión de los valores dominantes en la sociedad impedirá que quienes sienten la tentación de cometer delitos lo hagan.
Crime will be shunned and rejected by the society at large. Criminals and cheats will not be accepted, nor will wealth or any perceived benefits gained illicitly be respected. This pressure from the dominant values in the society will prevent those who are tempted to commit crime from doing so.

El último recurso es el temor a las consecuencias de las acciones delictivas en cuanto al castigo.
The last resort is the fear of the consequences of the criminal actions in terms of the punishment.
Por estas razones, fueron muy pocas las ocasiones en que fue necesaria la aplicación de los hudud y de otros castigos por parte del poder judicial en la historia del Califato.
It is for these reasons that so few incidences of implementation of hadud and other retributions by the judiciary were necessary in the history of the Khilafah.
