محتسب وہ قاضی ہے جو ان تمام مقدمات کا فیصلہ کرتا ہے جن کا تعلق عوامی حقوق سے ہو اور جن میں کوئی مدعی نہ ہو، جب تک کہ یہ مقدمات حدود اور جنایات کے دائرہ کار میں نہ آتے ہوں۔

یہ احتساب کے قاضی کی تعریف ہے، جو کہ کھانے کے ڈھیر سے متعلق حدیث سے اخذ کی گئی ہے۔ اللہ کے رسول ﷺ نے کھانے کے ڈھیر میں نمی دریافت کی تو آپ ﷺ نے حکم دیا کہ نم خوراک کو اوپر دکھایا جائے تاکہ لوگ اسے دیکھ سکیں۔ پس یہ ایک عوامی حق تھا جس کا اللہ کے رسول ﷺ نے جائزہ لیا، اور فیصلہ کیا کہ دھوکہ دہی سے بچنے کے لیے گیلی خوراک کو اوپر دکھایا جانا چاہیے۔ یہ ان تمام عوامی حقوق یا مفادات پر لاگو ہوتا ہے جو اس نوعیت کے ہیں۔ اس میں تعزیرات یا فوجداری قانون شامل نہیں ہے، کیونکہ وہ اس نوعیت کے نہیں ہیں، کیونکہ وہ بنیادی طور پر لوگوں کے درمیان تنازعات ہوتے ہیں۔

This is the definition of the judge of Hisbah, which is a definition deduced from the hadith relating to the heap of food. The Messenger of Allah (PBUH) discovered dampness in the heap of food so he ordered that the damp food be displayed on the top so that people could see it. So this was a public right on which the Messenger of Allah looked into, and judged that the wet food should be displayed at the top to prevent cheating. This applies to all the public rights or interests that are of this nature.
