13.7 The mandatory powers of the Ummah’s council

1۔ امت کا کونسل درج ذیل لازمی اختیارات رکھتا ہے اور وہ یہ ہیں: ۔

1. The Council of the Ummah has the following mandatory powers and they are: .

(الف): خلیفہ کے لیے ضروری ہے کہ وہ مجلس سے مشورہ کرے اور مجلس کو یہ حق حاصل ہے کہ وہ اسے ان عملی معاملات اور اقدامات میں مشورہ دے جو داخلی پالیسی کے امور کی انجام دہی سے متعلق ہوں اور جن کے لیے گہری سوچ بچار اور باریک بینی کی ضرورت نہ ہو، جیسے کہ ضروری خدمات کی فراہمی تاکہ حکمرانی، تعلیم، صحت، معیشت، تجارت، صنعت، زراعت اور اس جیسی دیگر چیزوں کے معاملات میں زندگی کا سکون میسر آ سکے۔ اس کے علاوہ، اپنے شہروں کے دفاع کو مضبوط کرنا، اپنی سلامتی کی حفاظت کرنا اور دشمن کے خطرے کو دور کرنا۔ ان معاملات میں مجلس کی رائے خلیفہ پر لازم ہے، یعنی اکثریت کی رائے پر عمل کیا جائے گا۔

(a): The Khalifah has to consult the Council and the Council has the right to advise him in the practical matters and actions related to discharging the affairs of the domestic policy that do not require profound thought and scrutiny such as provision of the necessary services so as to enjoy the tranquillity in life in terms of the matters of ruling, education, health, economy, trading, industry, farming and the like. In addition, strengthening the defences of their cities, saving their security and driving the danger of their enemy. The opinion of the Council in these matters is binding to the Khalifah, i.e. the opinion of the majority is executed. .

۲۔ قانون سازی کے سلسلے میں کونسل کی رائے نہیں لی جاتی؛ بلکہ قانون سازی اللہ کی کتاب، اس کے رسول ﷺ کی سنت اور صحابہ کے اجماع اور معتبر اجتہاد کے ذریعے الٰہی قیاس سے حاصل کی جاتی ہے۔ احکامِ شریعت کا اطلاق اور قوانین کی وضع کرنا اسی طریقے سے ہوگا۔ خلیفہ کو یہ حق حاصل ہے کہ وہ ان قوانین اور قواعد کو کونسل کے سامنے پیش کرے جنہیں وہ نافذ کرنا چاہتا ہے۔ کونسل کے مسلم ارکان کو یہ حق حاصل ہے کہ وہ ان پر بحث کریں اور ان قواعد کے بارے میں اپنی رائے کا اظہار کریں۔ تاہم، اگر وہ خلیفہ سے ان کے استدلال یا ان کی دلیل کی صحت کے بارے میں اختلاف کریں، یعنی ریاست میں اپنائے گئے الٰہی اصولوں سے اخذ کرنے کے طریقے پر ان کا اختلاف ہو، تو فیصلہ محکمہ المظالم کے سپرد کیا جائے گا، اور اس معاملے میں اس کا فیصلہ لازم ہوگا۔

2. The opinion of the council is not sought regarding legislation; the legislation is rather taken from the Book of Allah, the Sunnah of His Messenger and from what they alluded to in terms of ijmaa'us-sahabah and the divine qiyas, through valid ijtihad. The adoption of the ahkam shariah and enacting of laws would take place in this way. The Khalifah has the right to refer to the Council the laws and rules which he wants to adopt. The Muslim members of the Council have the right to debate them and voice their opinions regarding those rules. However, if they disagreed with the Khalifah regarding the validity of their deduction or their evidence, in terms of their disagreement with the method of adoption from the divine foundations (usool) adopted in the State, then the decision will refer to mahkamat ul-mathalim, and its verdict in this matter is binding. .

پہلا نکتہ (ب): اصولاً، خلیفہ اس باب کے معاملات کے متعلق علماء، ماہرین اور متخصصین کی رائے لیتا ہے۔ یہ اس بات کے عین مطابق ہے جو رسول اللہ ﷺ کے ساتھ پیش آیا جب آپ ﷺ نے جنگِ بدر کے مقام کے انتخاب کے سلسلے میں حباب بن المنذر کی رائے لی۔ سیرت ابن ہشام میں روایت ہے: "جب رسول اللہ ﷺ بدر کے پانی کے قریب ترین جانب پڑاؤ ڈال رہے تھے، تو حباب بن المنذر اس مقام پر مطمئن نہ ہوئے۔ انہوں نے رسول اللہ ﷺ سے کہا: اے اللہ کے رسول! کیا اللہ نے آپ کو اس جگہ پڑاؤ ڈالنے کا حکم دیا ہے جہاں سے ہم ہٹ نہیں سکتے، یا یہ رائے، جنگ اور حکمتِ عملی ہے؟" آپ ﷺ نے فرمایا: "بلکہ یہ رائے، جنگ اور حکمتِ عملی ہے"۔ حباب بن المنذر نے کہا: "اے اللہ کے رسول، یہ (درست) جگہ نہیں ہے۔ لوگوں کو وہاں تک لے جائیں جہاں تک ہم پانی کے اس کنارے تک پہنچ جائیں جو دشمن کے قریب ہو، ہم وہاں پڑاؤ ڈالیں، پھر ہم دوسری طرف سے پانی کا رخ موڑ دیں، اس کے اوپر ایک حوض بنائیں اور اسے پانی سے بھر دیں۔ پھر ہم ان لوگوں کے خلاف لڑیں جہاں ہم پانی پی سکیں اور وہ نہ پی سکیں"۔ رسول اللہ ﷺ نے فرمایا: "آپ نے (درست) رائے دی ہے"۔ چنانچہ رسول اللہ ﷺ اور مسلمانوں نے کوچ کیا اور اس وقت تک چلتے رہے جب تک وہ دشمن کے قریب پانی کے کنارے تک نہ پہنچ گئے اور وہاں پڑاؤ ڈال لیا۔

The first point (b): In principle, the Khalifah takes the opinion of the scholars and the experts and the specialists regarding the matters of this section. This is in accordance with what happened with the Messenger of Allah ( PBUH) when he took the opinion of Al-Habab b. Al-Mundhir in selecting the location of the battle of Badr. It was reported in the Sirah of ibn Hisham: “When the Messenger (PBUH) camped at the nearest side of the water of Badr, Al-Habbab ibn Al-Mundhir was not content with that site. He said to the Messenger: “O Messenger of Allah! Did Allah make you camp in this place where we can’t depart from it, or is it the opinion, war and strategy?” He (PBUH) said: “It is rather the opinion, war and strategy”. Al-Habbab b. Al-Mundhir said: “O Messenger of Allah, this is not the (right) place. Move the people till we come to the side of the water near to the people (enemy), we camp there, then we seep away the water from the other part, we build a basin on top of it, we fill it with water. Then we fight against the people where we drink and they do not”. The Messenger of Allah (PBUH) said: “You gave the (right) opinion”. So the Messenger of Allah (PBUH) and the Muslims stood up and walked till they reached the near side of the water from the enemy and camped there. .

یہ معاملہ مالیاتی امور پر بھی لاگو ہوتا ہے، کیونکہ شریعت نے ان فنڈز کی اقسام متعین کر دی ہیں جنہیں جمع کرنا ضروری ہے، اور ان شعبوں کا بھی تعین کر دیا ہے جن پر انہیں خرچ کرنا ہے۔ شریعت نے ان حالات کا بھی تعین کر دیا ہے جن میں ٹیکس عائد کیے جاتے ہیں؛ لہٰذا فنڈز کی وصولی اور ان کی تقسیم میں لوگوں کی رائے لینے کا کوئی فائدہ نہیں۔ اسی طرح فوج کا معاملہ بھی ہے، شریعت نے فوج کے معاملات کے انتظام کا حق خلیفہ کے لیے چھوڑ دیا ہے، اور جہاد کے قواعد بھی متعین کر دیے ہیں۔ شریعت کے ذریعے طے شدہ معاملات میں لوگوں کی رائے کی کوئی حیثیت نہیں۔ یہ بات ریاست کے دیگر ریاستوں کے ساتھ تعلقات پر بھی لاگو ہوتی ہے، کیونکہ یہ اس قسم کی سوچ ہے جس کے لیے مطالعہ اور گہری بصیرت درکار ہے اور اس کا تعلق جہاد سے ہے۔ مزید برآں، یہ رائے، جنگ اور حکمتِ عملی کا حصہ ہے۔ لہٰذا، اس معاملے میں لوگوں کی رائے کا کوئی فائدہ نہیں، خواہ وہ اکثریت میں ہوں یا اقلیت میں۔ تاہم، خلیفہ کو یہ اجازت ہے کہ وہ ان معاملات کو امت کی مجلس کے سامنے مشاورت اور رائے کے لیے پیش کرے، کیونکہ اس طرح کی پیشکش مباح میں سے ہے، اور ان معاملات میں مجلس کی رائے لازم نہیں ہے جیسا کہ بدر کا واقعہ تھا۔ بلکہ فیصلہ متعلقہ شخص کے سپرد ہے۔ (الف) اور (ب) کے نکات کے درمیان فرق واضح کرنے کے لیے ہم کہتے ہیں:

This also applies to the financial matters, because the Sharia has determined the types of funds which must be collected, and the areas over which they need to be allocated (spent). The Sharia has also determined the cases when taxes are imposed; therefore there is no point in seeking the opinion of the people in the collection and allocation of the funds. Similar to this is the army, the Sharia has left to the Khalifah the right of managing the army’s affairs, and it determined the rules of Jihad. There is no validity in the opinion of the people over matters decided by the Sharia. This also applies to the relationship of the State with other States, because this is of the thought that requires study and deep insight and is related to Jihad. Furthermore it is a part of the opinion, war and strategy. Therefore, there is no point in the opinion of the people in this matter whether it is the majority or minority. However the Khalifah is allowed to present these matters to the Council of the Ummah for its consultation and opinion, because such presentation is of the Mubah, and the opinion of the Council in these matters is not binding as in the incident of Badr. Rather the decision is entrusted with the concerned person.. To distinguish the difference between points (a) and (b), we say: .

اسی طرح، کسی گاؤں کے بچوں کے لیے اسکول کی تعمیر، جہاں ان بچوں کو شہروں کے اسکولوں تک پہنچنے میں شدید دشواری کا سامنا ہو، اس معاملے میں امت کے کونسل کی اکثریت کی رائے خلیفہ پر لازم ہے۔ گاؤں میں اسکول کے مقام کے انتخاب کے حوالے سے، جہاں مٹی کی مضبوطی ڈیزائن کے لیے موزوں ہو، اور ساتھ ہی اس کی تعمیر کے انداز کے بارے میں، خواہ وہ ریاست کی ملکیت میں ہو، یعنی اسے تعمیر کیا گیا ہو، خریدا گیا ہو یا لیز پر لیا گیا ہو، ایسے معاملات میں ماہرین اور خصوصی افراد سے مشورہ کیا جاتا ہے؛ اور کونسل کی اکثریت کی رائے نہیں لی جاتی، اگرچہ خلیفہ کو اس معاملے پر ان سے مشورہ کرنے کی اجازت ہے، لیکن ان کی رائے لازم نہیں ہے۔ جہاں تک سرحدوں پر واقع کسی ملک کا تعلق ہے، جو دشمن کے خطرے کے باوجود ہو، تو گاؤں کی قلعہ بندی کرنے، اس سے دشمن کے خطرے کو دور کرنے، اور دشمن کے کسی بھی حملے کے بعد اسے قتل اور بے دخلی سے بچانے کے حوالے سے امت کی کونسل کی اکثریت کی رائے لازم ہے۔ تاہم، ایسی قلعہ بندیوں کی تعمیر کا طریقہ کار اور خطرے کو دور کرنے کے لیے استعمال ہونے والے جنگی ذرائع؛ ان چیزوں کے لیے کونسل کی اکثریت کی رائے کے بجائے ماہرین اور خصوصی افراد کے مشورے کی ضرورت ہوتی ہے۔

Likewise, building a school for the children of a village, where its children find great difficulty in reaching the schools in the towns, the majority opinion of the council of the Ummah on this matter is binding to the Khalifah. In regards to the choice of the location of the school in the village in terms of the soil strength suitable for design, as well as the style of its building, whether is possessed by the State, i.e. it is built, bought or leased, in such matters the experts and specialised people are consulted; and the majority opinion of the council is not sought, though the Khalifah is allowed to consult with them over the matter, but their opinion is not binding.. As regarding a country at the frontiers, defying the danger of an enemy, then the majority opinion of the council of the Ummah is binding in terms of the village's fortification and driving the danger of the enemy away from it, and preventing its exposure to killing and expulsion after any aggression from the enemy. However, the method of building such fortifications and any fighting means used to drive the danger away from it; such things need the consultation of the experts and specialized people, rather than the majority opinion of the council. .

لہٰذا قانون سازی کے معاملے میں لوگوں کی رائے نہیں لی جاتی۔ اس کی بنیاد پر، احکامِ شریعت کو اپنانا، قوانین وضع کرنا اور قواعد و ضوابط کا نفاذ، جیسا کہ پہلے وضاحت کی جا چکی ہے، صرف خلیفہ کے لازمی اختیارات میں شامل ہے۔ تاہم، خلیفہ کے لیے یہ جائز ہے کہ وہ احکامِ شریعت اور قواعد میں سے جو کچھ اپنانا چاہتا ہو، اس کے بارے میں امت کی کونسل سے مشورہ لے تاکہ اس بارے میں ان کی رائے معلوم کر سکے۔ یہ بالکل ویسا ہی ہے جیسا کہ عمر بن الخطاب (رضی اللہ عنہ) نے کیا جب انہوں نے الٰہی قوانین کے معاملے میں مسلمانوں سے رجوع کیا، جس پر صحابہ نے کوئی اعتراض نہیں کیا، جیسا کہ عراق کے فتح شدہ علاقوں کے واقعے میں ہوا، جب مسلمانوں نے ان سے درخواست کی کہ زمینوں کو ان مجاہدین میں تقسیم کر دیا جائے جنہوں نے انہیں فتح کیا تھا۔ چنانچہ عمر (رضی اللہ عنہ) نے لوگوں سے پوچھا، لیکن ان کی رائے اس پر قائم ہوئی کہ زمین کو اس کے مالکان کے پاس ہی رہنے دیا جائے بشرطیکہ وہ اپنی ذات پر جزیہ ادا کرنے کے ساتھ ساتھ اس زمین پر ایک متعین خراج بھی ادا کریں۔ عمر (رضی اللہ عنہ) اور ان سے قبل ابوبکر (رضی اللہ عنہ) کا الٰہی قوانین کے بارے میں رائے کے لیے صحابہ سے رجوع کرنا اور صحابہ کی جانب سے اس پر کسی اعتراض کا نہ ہونا، ان کے اجماع کی نشاندہی کرتا ہے۔ یہ اس بات کی دلیل ہے کہ خلیفہ کو یہ کرنے کا حق حاصل ہے۔ جہاں تک محکمۃ المظالم سے رجوع کرنے کا تعلق ہے، اس صورت میں جب خلیفہ ان قواعد کی صحت کے بارے میں، یا ان کے دلائل یا ریاست کے اپنائے ہوئے اصولوں سے ان کے اخذ کیے جانے کی شرائط کے بارے میں امت کی کونسل سے اختلاف کرے، تو اس صورت میں مظالم کے قاضی کا اختیار یہ ہے کہ وہ خلیفہ کے اپنائے ہوئے حکم کا جائزہ لے کہ آیا اس کا کوئی الٰہی دلیل موجود ہے اور کیا وہ دلیل اس واقعے پر صادق آتی ہے۔ لہٰذا، اگر خلیفہ کونسل (یعنی کونسل کی اکثریت) کے ساتھ اس حکم کے بارے میں اختلاف کرے جسے خلیفہ نے اپنایا ہے کہ آیا وہ ایک صحیح حکم شرعی ہے یا نہیں، تو اس تنازعے کا فیصلہ مظالم کا قاضی کرے گا، کیونکہ یہ اس کی مہارت کا حصہ ہے؛ اور محکمۃ المظالم کی رائے لازم ہے۔

therefore the opinion of the people is not sought regarding legislation. Based on that, the adoption of the ahkam shariah, enacting of laws and the adoption of the rules and cannons are of the mandatory powers of the Khalifah alone as explained before. However, it is allowed for the Khalifah to submit to the council of the Ummah whatever he wants to adopt of ahkam shariah and cannons so as to find out its opinion regarding it. This is like what ‘Umar b. Al- Khattab (ra) did when he referred to the Muslims over the divine rules, which the Sahabah did not object to, as in the incident of the conquered lands of Iraq, when the Muslims asked him to divide the lands amongst the fighters who opened them. So ‘Umar asked the people, but his opinion settled on keeping the land with its landlords on condition that they pay a known Kharaj over it in addition to paying the Jizya over their persons. The reference of ‘Umar and Abu Bakr before him to the Sahabah for their opinion over the divine rules without an objection from the Sahabah to this indicates their Ijma’. This serves as evidence that the Khalifah has the right to do that.. With regard to reference to the mahkamat al-Mazalim in case the Khalifah differed with the council of the Ummah regarding the validity of the deduction of these cannons, or regarding their evidences or terms of the adoption from the sources (usool) adopted by the State. In this case the authority of Mathalim judge is to examine the hukm adopted by the Khalifah, whether it has divine evidence and whether the evidence applies to the incident. Therefore, if the Khalifah differed with the council (i.e. the majority of the council) over the hukm which the Khalifah adopted in terms of being a valid hukm shar’i or not, then this dispute is settled by the judge of Mazalim, because it is of his speciality; and the opinion of mahkamat ul-mathalim is binding. .

کونسل کے غیر مسلم ارکان کو ان احکام اور قوانین کے جائزے کا کوئی حق حاصل نہیں ہے جنہیں خلیفہ اپنانا چاہتا ہے۔ اس کی وجہ یہ ہے کہ وہ اسلام پر ایمان نہیں رکھتے، اور اس لیے کہ ان کا حق صرف ان خدشات کے اظہار تک محدود ہے جو حکمرانوں کی جانب سے ان پر ہونے والے کسی بھی ظلم کے متعلق ہوں، نہ کہ الٰہی احکام اور قوانین کے بارے میں اپنی رائے کا اظہار کرنا۔ تیسرے نکتے کے حوالے سے، اس کی دلیل حکمرانوں کو محاسبہ میں لانے سے متعلق نصوص کا عمومی مفہوم ہے۔ احمد نے ابن عمر رضی اللہ عنہما سے روایت کی ہے، جنہوں نے کہا: "رسول اللہ ﷺ نے فرمایا: تمہارے اوپر ایسے امیر ہوں گے جو تمہیں ایسے کاموں کا حکم دیں گے جو وہ خود نہیں کرتے۔ جو شخص ان کے جھوٹ پر ان کی تصدیق کرے گا اور ان کی ناانصافی میں ان کی مدد کرے گا، وہ میرا نہیں ہوگا اور نہ میں اس کا ہوں گا، اور وہ حوض پر میرے ساتھ نہیں مل سکے گا۔" [al-Mundhiry, al-Targhib wa’l-Tarhib, vol.3, p.2203]۔ احمد نے ابو سعید خدری رضی اللہ عنہ سے روایت کی ہے، جنہوں نے کہا: "رسول اللہ ﷺ نے فرمایا: "...بہترین جہاد ظالم حکمران کے سامنے حق بات کہنا ہے"۔" [Abu Dawud, Sunan, #4344]۔ الحاکم نے جابر رضی اللہ عنہ سے، انہوں نے نبی ﷺ سے روایت کی ہے جنہوں نے فرمایا: "شہیدوں کا سردار حمزہ بن عبدالمطلب ہے اور وہ شخص جو کسی ظالم حکمران کے سامنے کھڑا ہوا، جب اس نے (حکمران نے) اسے حکم دیا اور اس نے منع کیا، پس اس (حکمران) نے اسے قتل کر دیا"۔ [Al-Mundhiry, al-Targhib wa’l-Tarhib, vol.3, p.229]۔ مسلم نے ام سلمہ رضی اللہ عنہا سے روایت کی ہے کہ رسول اللہ ﷺ نے فرمایا:

Non-Muslim members of the council have no right in examining the ahkam and cannons which the Khalifah wants to adopt. This is because they do not believe in Islam, and because their right is restricted to voicing their concerns regarding any oppression that might fall upon them from the rulers, rather than expressing their view regarding the divine ahkam and canons.. With regards to the third point, its evidence is the general meaning of the texts related to bringing the rulers to task. Ahmad narrated from Ibn ‘Umar, who said: “The Messenger of Allah (PBUH) said: “There will be Amirs over you who order you of things they do not do. Whoever believed them in their lies and helped them in their injustice he would not belong to me nor I belong to him, and he will not join me on the Hawd (basin)”. [al-Mundhiry, al- Targhib wa’l-Tarhib, vol.3, p.2203]. Ahmad narrated from Abu Sa’id al-Khudri, who said: “The Messenger of Allah (PBUH) said:. “…The best of Jihad is (to say) a word of truth before an oppressor ruler”.” [Abu Dawud, Sunan, #4344]. Al-Hakim narrated from Jabir from the Prophet (PBUH) who said: “The master of martyrs is Hamza b. ‘Abd al-Muttalib and a man who stood to an oppressor ruler where he ordered him and forbade him so he (the ruler) killed him.” [Al-Mundhiry, al-Targhib wa’l-Tarhib, vol.3, p.229]. Muslim narrated from Umm Salamah that the Messenger of Allah ( PBUH) said: .

یہ متن عمومی نوعیت کا ہے اور اس سے مراد شرعی قواعد کے مطابق حکمران کی احتساب ہے۔ مزید برآں، احتساب کسی بھی عمل پر ہو سکتا ہے۔ مجلس کی جانب سے خلیفہ ﷺ اور دیگر معاونین، گورنروں اور عاملوں کا احتساب کسی بھی ایسے عمل پر ہو سکتا ہے جو حقیقت میں انجام دیا گیا ہو، خواہ وہ عمل الٰہی حکم کے خلاف ہو، غلط ہو یا مسلمانوں کے لیے نقصان دہ ہو، یا شہریوں کے معاملات کی دیکھ بھال میں ناانصافی یا غفلت پر مبنی ہو۔ خلیفہ ﷺ پر لازم ہے کہ وہ اپنے اقوال، افعال اور انجام دیے گئے فرائض کے حوالے سے اپنا نظریہ اور دلیل پیش کر کے اس احتساب اور اعتراضات کا جواب دیں، تاکہ مجلس خلیفہ ﷺ کی اچھی کارکردگی، اخلاص اور دیانتداری کے بارے میں مطمئن ہو سکے۔ تاہم، اگر مجلس خلیفہ ﷺ کے نظریے کو قبول نہ کرے اور ان کے استدلال کو مسترد کر دے، تو اس کی جانچ پڑتال ہونی چاہیے۔ اگر یہ معاملہ ان مسائل میں سے تھا جن میں اکثریت کی رائے لازم ہے، تو مجلس کی رائے بھی [a] میں مذکور مسائل کی طرح لازم ہوگی، ورنہ یہ [a] کے مسائل کی طرح نہیں ہوگی۔ مثال کے طور پر، اگر احتساب پچھلی مثال میں دی گئی سکول کی فراہمی نہ کرنے کے بارے میں تھا، تو احتساب لازم ہوگا۔ لیکن اگر احتساب سکول کے لیے اس کے منتخب کردہ ڈیزائن کے بارے میں تھا، تو اس کا احتساب لازم نہیں ہوگا۔

These texts are in general form and indicate accounting of the ruler in accordance with the rules of the shara’. Furthermore accounting can be over any action. This accounting by the Council to the Khalifah and other assistants, governors and ‘Amils would be over any action which has been actually executed whether this action disagreed with the divine rule, was wrong or harmful to Muslims, or was unjust or complacent toward the citizens in looking after their affairs. The Khalifah must respond to this accounting and the objections by showing his view and evidence regarding his words, actions and tasks he undertook, so that the Council can be assured of the good performance, the sincerity and honesty of the Khalifah. If however the Council does not accept the view of the Khalifah and rejects his argument, this must be examined. If this matter was of the issues over which the majority opinion is binding then the opinion of the Council is binding like the issues in (a), otherwise it would not be like the issues in (a). If the accounting for example was regarding not providing the school in the previous example then the accounting is binding.
